Wind farming on Croft Land
Brian Inkster is deeply involved in providing advice on how crofting law affects proposed wind farm developments on croft land.
In 2003, Brian provided advice on agreements for wind farm developments under section 5(3) the Crofters Scotland Act 1993.
Brian gave submissions on ‘Schemes for Development’, as proposed by the draft Crofting Reform (Scotland) Bill, to the Scottish Executive in 2005. This was during the consultation process that led to the enactment of the Crofting Reform etc. Act 2007.
Part 5 of the Crofting Reform etc. Act 2007 covering ‘Schemes for Development’ introduced section 19A to the Crofters (Scotland) Act 1993 which came into effect on 25 June 2007. It is likely that Schemes for Development will now become the obvious route for developers of wind farms on croft land.

Brian gave a talk on 'Drafting Crofting Clauses in Wind Farm Leases and the Section 19A Application/Intimation' at the Crofting Law Conference organised by the WS Society, in association with the Crofting Law Group, and held in Inverness on 30 May 2008. A lecture given by Brian on 23 February 2009 to the LLB Property Law class at the University of Strathclyde included a section on Schemes for Development.
