Views sought on changes to law affecting landlords

The Scottish Government today launched a consultation aimed at improving the Private rental housing sector. Views from interested parties are sought on a number of suggested changes to the law in this area.
Particularly interesting in light of recent news stories such as this one are the consultation’s suggestions about preventing overcrowding in privately rented homes. The consultation also suggests changes such as strengthening the HMO regime, including the introduction of ‘rent repayment orders’, forcing landlords to repay rent paid towards unlicenced HMO properties. Simplification of the forms and notices required for Short Assured Tenancies, changes to landlord registration including an increase in offences which landlords must declare when registering, and making unreasonable pre-tenancy charges illegal, are also raised as possible reforms.
